However, you could be held liable for losses incurred by Performance Packaging, Inc. or another party due to someone else using your account or password. As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these Terms of Service, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Performance Packaging, Inc. server, or the network(s) connected to any Performance Packaging, Inc. server, or interfere with any other party's use and enjoyment of any Services. All pricing and product information is subject to change and Performance Packaging, Inc. reserves the right to make adjustments, without notice, for any reason. The product prices listed do not include shipping charges, taxes, or any other potentially applicable fees. Customers with tax exemption status are required to provide documentation for such at checkout.
Customer must provide their preferred shipping method at checkout. Upon product delivery to the customer or carrier, all risk of loss or damage to product transfers to the Customer. Performance Packaging, Inc. shall not be held liable for any delay in meeting expected shipping dates for reasons beyond Performance Packaging, Inc.'s control including, without limitation: strikes, labor stoppages, extreme weather events, power outages, or governmental order.
Products can be returned within 30 days for a refund, provided they are in resalable condition. Custom items and products marked as "non-returnable" are not eligible for return. No partial units may be returned for credit. The customer is responsible for return shipping charges and manufacturer restocking fees up to 15% or as dictated by the third-party manufacturer. Performance Packaging, Inc. disclaims all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. Although Performance Packaging, Inc. employees may advise as to product fit for a given use case, this shall not imply or guarantee a warranty.
Performance Packaging Inc. will not be liable for any damages and is not responsible for delays in delivery that may result from any circumstances beyond Performance Packaging's control and will not be liable for damages resulting from such delays. If a Customer claim is made, Performance Packaging's aggregate liability will not exceed the purchase price paid by the Customer for the products to which the claim relates.
To the extent allowed by law, Customer agrees to protect, defend, indemnify and hold harmless Performance Packaging Inc, its officers and employees against any and all claims, and any and all liabilities, judgements, penalties, settlements and costs arising from or related to any actual or alleged negligence or misconduct of Customer as related to Customer's purchase, sale or use of Performance Packaging Inc. products.

You may text "stop" to the number from which you received the communication at any time to unsubscribe from further text communication. Performance Packaging, Inc. is not liable for any charges incurred related to the receipt of SMS/Text messages.
These Terms of Service, and all claims or causes of action that may be based upon, arise out of, or relate to these Terms of Service or the purchase, sale, or any use of the products from Performance Packaging, Inc., shall be governed by, and enforced in accordance with the internal laws of the State of Michigan, without regard to its conflict of laws principles.
If a provision of these Terms is found to be unenforceable by a court of law, such provision will be modified or removed, but only to the extent necessary to comply with the given ruling and the remainder of these Terms shall remain in full effect.
